These Terms of Service, together with any additional terms referenced in this document, are a legal agreement between you and New Age Culinary LLC (“New Age Culinary,” “OnHand,” “we,” “us,” or “our”) governing your access to and use of OnHand: Cook What You Have, the OnHand mobile application, the OnHand website located at https://www.cookonhand.app, and any related services, features, content, subscriptions, recipe generation tools, community recipe features, and support services we provide (collectively, the “Service”).

Please read these Terms carefully. By downloading, accessing, purchasing, subscribing to, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of the Service

OnHand is a recipe app that helps users create personalized, AI-generated recipes based on the ingredients, tools, preferences, restrictions, serving needs, and time limits they provide. OnHand may also use recipe source information from third-party websites to help ground recipe suggestions. Users may save, rate, submit, and share recipes with the OnHand community, subject to review and approval.

The OnHand website is primarily used to provide information about the app, support information, legal documents, and links to download the app from the App Store.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the permission and supervision of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

The Service is intended for general audiences and is not directed specifically to children under 13.

4. Apple App Store Terms

If you download or use the OnHand app through the Apple App Store, the following additional terms apply:

  1. These Terms are between you and New Age Culinary LLC only, not Apple. New Age Culinary LLC, not Apple, is solely responsible for the Service and its content.

  2. The OnHand app is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the OnHand app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing rules.

  3. Apple has no obligation to provide maintenance or support services for the OnHand app. New Age Culinary LLC is solely responsible for providing support for the Service as described in these Terms or as required by applicable law.

  4. To the extent any warranty exists and is not effectively disclaimed, New Age Culinary LLC is solely responsible for that warranty. If the OnHand app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the OnHand app.

  5. New Age Culinary LLC, not Apple, is responsible for addressing any claims relating to the OnHand app or your possession or use of the app, including product liability claims, legal or regulatory compliance claims, and claims arising under consumer protection, privacy, or similar laws.

  6. If a third party claims that the OnHand app or your possession and use of the app infringes that third party’s intellectual property rights, New Age Culinary LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.

  7. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  8. You must comply with all applicable third-party terms when using the Service, including Apple’s terms, your wireless data service agreement, and the terms of any third-party services used in connection with the Service.

  9. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

5. Subscriptions, Billing, Free Trial, and Purchases

OnHand may require a paid subscription to access the full Service after onboarding. At launch, OnHand offers the following subscription options, subject to change:

  • Monthly subscription: $7.99 per month, auto-renewing monthly, with no free trial.

  • Yearly subscription: $23.99 per year, auto-renewing yearly, with a 3-day free trial.

Prices, plans, trial availability, features, and subscription terms may vary by region, promotion, App Store pricing changes, taxes, currency, or future updates to the Service. The exact price and terms shown to you at the time of purchase will control.

Subscriptions are purchased through Apple In-App Purchase and are billed through your Apple Account. Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period, or as otherwise provided by Apple’s terms. You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the app does not cancel your subscription.

If you start a free trial, your Apple Account may be charged automatically at the end of the trial period unless you cancel before the trial ends according to Apple’s rules. Refund requests are handled by Apple, not OnHand. We do not control Apple’s refund decisions.

If you uninstall and reinstall the app, you may be able to restore an active subscription by using the restore purchases option in the app, subject to Apple’s systems and your Apple Account status.

6. Free Onboarding Recipe

OnHand may allow users to create one free recipe during onboarding before requiring a subscription. This free recipe is intended to be limited to one per device or app installation state, but the exact availability may depend on local device storage, app settings, reinstall behavior, technical limitations, and future updates.

We may change, limit, remove, or modify free usage at any time.

7. “Unlimited” Use and Fair Use

A subscription may be described as “unlimited” because it allows subscribed users to create recipes without a fixed ordinary monthly recipe limit. However, unlimited use is subject to reasonable and lawful use of the Service.

You may not use the Service in a way that is abusive, automated, excessive, fraudulent, or intended to harm, overload, scrape, reverse engineer, disrupt, or exploit the Service or our third-party providers. This includes, but is not limited to, using bots, macros, scripts, emulators, automated tools, or other abnormal usage patterns to generate large volumes of recipes or consume unreasonable computing, AI, storage, network, or operational resources.

We reserve the right to limit, suspend, terminate, throttle, or otherwise restrict access to the Service if we reasonably believe your use violates these Terms, harms the Service, creates excessive costs, affects other users, or threatens the security or stability of the Service.

8. AI-Generated Content and Recipe Accuracy

OnHand uses artificial intelligence and other automated systems to generate and personalize recipes. OnHand may also use third-party recipe source information, search results, recipe pages, ingredients, instructions, serving information, and related publicly available information to help ground recipe suggestions. Source links may be shown in the app so users can view third-party recipe sources.

AI-generated content may be incomplete, inaccurate, unsafe, outdated, inconsistent, or unsuitable for your needs. OnHand may make mistakes. You are responsible for reviewing, verifying, and using your own judgment before relying on any recipe, ingredient, instruction, substitution, cooking method, temperature, time estimate, serving size, restriction, or other output provided by the Service.

You agree that you are solely responsible for determining whether a recipe is appropriate for you and anyone you cook for.

9. Food Safety, Allergies, Restrictions, Leftovers, and Health Disclaimer

The Service is provided for general cooking convenience and informational purposes only. OnHand does not provide medical, nutritional, dietary, allergy, food safety, food storage, food spoilage, or other professional advice.

You are solely responsible for determining whether any recipe, ingredient, instruction, substitution, cooking method, temperature, time estimate, serving size, storage suggestion, leftover use, or other output from the Service is safe, suitable, and appropriate for you and anyone you cook for.

OnHand cannot identify, inspect, smell, test, verify, or confirm the safety, freshness, quality, expiration status, storage history, handling history, contamination risk, spoilage risk, or allergen status of any ingredient, food item, leftover, prepared food, or cooking environment. You should not rely on the Service to determine whether food is safe to use, cook, eat, store, reheat, or serve.

You must independently verify all recipe outputs and follow applicable food safety guidance from reliable sources, including government food safety authorities such as the U.S. Food and Drug Administration, U.S. Department of Agriculture, FoodSafety.gov, and other applicable authorities. AI-generated cooking instructions, temperatures, times, doneness descriptions, storage suggestions, reheating suggestions, and leftover suggestions are not a substitute for official food safety guidelines or your own judgment.

You are responsible for using proper food safety practices, including but not limited to checking ingredients for freshness and spoilage; reviewing expiration or use-by dates; avoiding cross-contamination; washing hands, surfaces, and produce where appropriate; cooking foods to safe internal temperatures using a food thermometer where appropriate; properly cooling, refrigerating, freezing, storing, reheating, and discarding leftovers; and following any applicable recall, allergy, handling, storage, or preparation warnings.

OnHand may attempt to account for restrictions, preferences, allergies, intolerances, and user-provided information, but we do not guarantee that any recipe will be allergen-free, cross-contamination-free, medically appropriate, nutritionally accurate, safe, properly cooked, properly stored, or suitable for your specific circumstances.

If you or anyone you cook for has allergies, intolerances, medical conditions, dietary restrictions, pregnancy-related restrictions, immune system concerns, religious or ethical food restrictions, or any other health-related food needs, you should not rely on the Service as your only source of guidance. Consult an appropriate medical, nutrition, allergy, or food safety professional where appropriate.

You agree that you are solely responsible for your use of recipes, ingredients, instructions, substitutions, cooking methods, leftovers, storage practices, and food safety decisions, and that New Age Culinary LLC is not responsible for illness, allergic reactions, foodborne illness, contamination, spoilage, improper storage, improper reheating, undercooking, overcooking, cross-contamination, or other food-related harm arising from your use of the Service.

10. Third-Party Sources and Links

The Service may display links, titles, snippets, ingredients, instructions, or other information from third-party websites or services. These third-party sources are provided for convenience, grounding, attribution, or informational purposes only.

We do not own, control, endorse, verify, or guarantee third-party websites, recipes, content, ingredients, claims, safety instructions, nutrition information, ratings, reviews, or availability. Your use of third-party websites or services is at your own risk and may be governed by their own terms and privacy policies.

11. User Content and Community Submissions

The Service may allow you to submit, upload, rate, review, save, share, or provide recipes, photos, feedback, ingredient information, restrictions, preferences, ratings, comments, dislike reasons, and other content or information (“User Content”).

Community recipe submissions may include AI-generated recipes and user-uploaded hero images. At launch, community recipes are reviewed by a human before being added to the public recipe database. Submission does not guarantee approval or publication.

You are responsible for your User Content and represent that you have all rights necessary to submit it. You agree not to submit User Content that is illegal, harmful, unsafe, offensive, abusive, misleading, infringing, spammy, or otherwise violates these Terms.

You retain any rights you may have in User Content that you own. However, by submitting User Content to the Service, you grant New Age Culinary LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, use, reproduce, display, publish, distribute, modify, adapt, format, edit, remove, promote, and otherwise use your User Content in connection with operating, improving, marketing, and promoting the Service.

This license includes the right to display submitted recipes and photos publicly in the OnHand app, on the OnHand website, in promotional materials, and in other marketing or product experiences related to the Service.

If your submitted content includes a photo, you represent that you took the photo, own the photo, or otherwise have permission to submit and license it to us.

12. Review, Moderation, and Removal of Content

We reserve the right, but do not have the obligation, to review, approve, reject, edit, format, remove, hide, or modify any User Content or community recipe at any time, for any reason, including if we believe it violates these Terms, creates legal risk, is low quality, contains unsafe instructions, includes inappropriate content, or is not suitable for the Service.

We may use automated checks, manual review, user feedback, or other moderation methods to detect prohibited or unsafe content. These systems may not catch every issue.

At launch, OnHand does not provide direct user-to-user interaction. Users may report concerns, objectionable content, unsafe recipes, abusive behavior, or other issues by using available feedback features in the app, including dislike feedback where available, or by contacting support@cookonhand.app.

13. Attribution for Community Content

At launch, OnHand may display community recipes without public attribution to a specific user. In the future, if account features are added, OnHand may display a username or other limited attribution with community recipes. We will not intentionally display more personal information than is reasonably needed for the feature, subject to our Privacy Policy and app settings.

14. Prohibited Conduct

You agree not to:

  1. use the Service for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;

  2. submit poisonous, dangerous, unsafe, illegal, or intentionally harmful ingredients, recipes, instructions, or prompts;

  3. submit content that is offensive, harassing, threatening, hateful, explicit, defamatory, invasive of privacy, misleading, or otherwise objectionable;

  4. submit content that infringes or violates another person’s intellectual property, privacy, publicity, or other rights;

  5. upload photos, recipes, text, or other content you do not have the right to use;

  6. attempt to bypass paywalls, subscription checks, free usage limits, security systems, or technical restrictions;

  7. use bots, scripts, macros, scraping tools, automated systems, or similar methods to access or abuse the Service;

  8. reverse engineer, decompile, disassemble, modify, copy, or create derivative works of the app except as permitted by law;

  9. interfere with or disrupt the Service, servers, networks, APIs, AI systems, storage systems, or third-party providers;

  10. attempt to gain unauthorized access to accounts, systems, data, or infrastructure;

  11. use the Service to generate spam, deceptive content, or content intended to harm others; or

  12. use the Service in any way that violates these Terms or applicable law.

15. Accounts and Future Account Features

At launch, OnHand may not require users to create an account. Subscription access is handled through Apple In-App Purchase and Apple’s restore purchase systems.

In the future, we may offer optional account features such as Sign in with Apple, Google sign-in, email sign-in, personalized profiles, usernames, saved preferences, cross-device syncing, or other user-specific features. If account features are added, you may be responsible for keeping your login credentials secure and for activity associated with your account.

We may update these Terms when account features are introduced or changed.

16. Intellectual Property

The Service, including the OnHand app, website, name, logo, branding, design, user interface, software, source code, prompts, workflows, databases, curated content, text, graphics, features, and other materials, is owned by New Age Culinary LLC or its licensors and is protected by intellectual property and other laws.

Except for the limited license expressly granted to you in these Terms, we do not grant you any rights in the Service or our intellectual property.

You may use recipes generated for you by OnHand for personal cooking, saving, and sharing outside the app. You may also use photos of food you personally make. However, you may not copy, reproduce, scrape, redistribute, resell, or exploit substantial portions of the Service, app, database, recipe collection, design, or underlying technology without our permission.

17. Privacy

Your use of the Service is also governed by our Privacy Policy, available at:

The Privacy Policy explains how we collect, use, store, and share information, including information you provide in the app, recipe generation inputs, analytics information, subscription-related information, speech-related information, feedback, recipe snapshots, ratings, photos, and community submissions.

If you are a California resident, additional California privacy disclosures and rights may apply to you as described in our Privacy Policy, including any California Privacy Notice included in that policy.

18. Third-Party Services

The Service may rely on third-party services, software, platforms, APIs, SDKs, and infrastructure providers, including but not limited to Apple services, Apple In-App Purchase, Apple speech recognition services, Supabase, Serper, OpenRouter, Google AI models, Adapty, Mixpanel, and other providers that may be added or changed over time.

By using the Service, you acknowledge that your use may also be subject to applicable third-party terms, policies, and technical limitations. We are not responsible for third-party service outages, errors, limitations, decisions, data practices, or changes.

19. Changes to the Service

We may modify, update, add, remove, suspend, discontinue, limit, or change any part of the Service at any time, including features, recipe generation systems, AI providers, recipe categories, community recipes, free usage limits, subscription options, prices, moderation systems, supported tools, and available content.

We are not liable for any modification, suspension, or discontinuation of the Service, except where prohibited by law.

20. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, used the Service abusively, created legal or security risk, submitted prohibited content, attempted to bypass payment or technical restrictions, or otherwise harmed the Service, other users, or third-party providers.

You may stop using the Service at any time. If you have an active subscription, you must cancel it through your Apple Account subscription settings. Deleting the app does not cancel your subscription.

Sections of these Terms that by their nature should survive termination will survive, including ownership, licenses, disclaimers, limitation of liability, indemnity, dispute terms, and Apple-related terms.

21. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.

We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, safety, and suitability.

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free;

  • recipes will be accurate, safe, complete, or suitable;

  • AI-generated content will be correct or reliable;

  • third-party sources will be accurate or available;

  • the Service will meet your expectations;

  • defects will be corrected; or

  • the Service will be free of harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by law, New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, service interruption, device issues, personal injury, food-related harm, allergic reaction, illness, or other damages arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to OnHand for the Service during the twelve months before the event giving rise to the claim; or (b) fifty U.S. dollars ($50).

Nothing in these Terms limits liability that cannot be limited under applicable law.

23. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use or misuse of the Service;

  • your violation of these Terms;

  • your User Content;

  • your violation of another person’s rights;

  • your violation of applicable law; or

  • your reliance on recipes, ingredients, instructions, substitutions, or other outputs from the Service.

24. Governing Law, Arbitration, and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Please read this Section carefully. You and New Age Culinary LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, the OnHand app, your subscription, or your use of the Service will be resolved by binding individual arbitration, rather than in court, except as stated below.

Arbitration is a process where a neutral arbitrator, not a judge or jury, decides a dispute. By agreeing to these Terms, you and New Age Culinary LLC each waive the right to bring covered disputes in court and the right to have those disputes decided by a judge or jury.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. Before starting arbitration, the party bringing the claim must send the other party written notice describing the dispute and requested relief. Notices to New Age Culinary LLC must be sent to support@cookonhand.app. The parties will try in good faith to resolve the dispute informally for at least 30 days before arbitration begins.

You may opt out of this arbitration agreement by sending written notice to support@cookonhand.app within 30 days after you first accept these Terms. Your notice must clearly state that you want to opt out of arbitration.

You and New Age Culinary LLC agree that disputes must be brought only on an individual basis. You and New Age Culinary LLC waive the right to bring, join, or participate in any class action, class arbitration, collective action, representative action, or similar proceeding, to the maximum extent permitted by law.

This arbitration agreement does not prevent either party from bringing an individual claim in small claims court if the claim qualifies. It also does not prevent either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, security, confidential information, or unauthorized use of the Service.

If any part of this arbitration agreement is found unenforceable, the remaining parts will remain in effect. For any dispute that is not subject to arbitration, you and New Age Culinary LLC agree that the dispute will be brought exclusively in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms from time to time. If we make changes, we may notify you by posting the updated Terms in the app, on our website, or by other reasonable means. The updated Terms will be effective as of the effective date shown at the top of the Terms, unless otherwise stated.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel any active subscription through your Apple Account settings.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented in the Service, make up the entire agreement between you and New Age Culinary LLC regarding the Service and replace any prior agreements or understandings regarding the Service.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Subscriptions are purchased through Apple In-App Purchase and are billed through your Apple Account. Your subscription automatically renews unless canceled at least 24 hours before the end of the current billing period, or as otherwise provided by Apple’s terms. You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the app does not cancel your subscription.

If you start a free trial, your Apple Account may be charged automatically at the end of the trial period unless you cancel before the trial ends according to Apple’s rules. Refund requests are handled by Apple, not OnHand. We do not control Apple’s refund decisions.

If you uninstall and reinstall the app, you may be able to restore an active subscription by using the restore purchases option in the app, subject to Apple’s systems and your Apple Account status.

6. Free Onboarding Recipe

OnHand may allow users to create one free recipe during onboarding before requiring a subscription. This free recipe is intended to be limited to one per device or app installation state, but the exact availability may depend on local device storage, app settings, reinstall behavior, technical limitations, and future updates.

We may change, limit, remove, or modify free usage at any time.

7. “Unlimited” Use and Fair Use

A subscription may be described as “unlimited” because it allows subscribed users to create recipes without a fixed ordinary monthly recipe limit. However, unlimited use is subject to reasonable and lawful use of the Service.

You may not use the Service in a way that is abusive, automated, excessive, fraudulent, or intended to harm, overload, scrape, reverse engineer, disrupt, or exploit the Service or our third-party providers. This includes, but is not limited to, using bots, macros, scripts, emulators, automated tools, or other abnormal usage patterns to generate large volumes of recipes or consume unreasonable computing, AI, storage, network, or operational resources.

We reserve the right to limit, suspend, terminate, throttle, or otherwise restrict access to the Service if we reasonably believe your use violates these Terms, harms the Service, creates excessive costs, affects other users, or threatens the security or stability of the Service.

8. AI-Generated Content and Recipe Accuracy

OnHand uses artificial intelligence and other automated systems to generate and personalize recipes. OnHand may also use third-party recipe source information, search results, recipe pages, ingredients, instructions, serving information, and related publicly available information to help ground recipe suggestions. Source links may be shown in the app so users can view third-party recipe sources.

AI-generated content may be incomplete, inaccurate, unsafe, outdated, inconsistent, or unsuitable for your needs. OnHand may make mistakes. You are responsible for reviewing, verifying, and using your own judgment before relying on any recipe, ingredient, instruction, substitution, cooking method, temperature, time estimate, serving size, restriction, or other output provided by the Service.

You agree that you are solely responsible for determining whether a recipe is appropriate for you and anyone you cook for.

9. Food Safety, Allergies, Restrictions, Leftovers, and Health Disclaimer

The Service is provided for general cooking convenience and informational purposes only. OnHand does not provide medical, nutritional, dietary, allergy, food safety, food storage, food spoilage, or other professional advice.

You are solely responsible for determining whether any recipe, ingredient, instruction, substitution, cooking method, temperature, time estimate, serving size, storage suggestion, leftover use, or other output from the Service is safe, suitable, and appropriate for you and anyone you cook for.

OnHand cannot identify, inspect, smell, test, verify, or confirm the safety, freshness, quality, expiration status, storage history, handling history, contamination risk, spoilage risk, or allergen status of any ingredient, food item, leftover, prepared food, or cooking environment. You should not rely on the Service to determine whether food is safe to use, cook, eat, store, reheat, or serve.

You must independently verify all recipe outputs and follow applicable food safety guidance from reliable sources, including government food safety authorities such as the U.S. Food and Drug Administration, U.S. Department of Agriculture, FoodSafety.gov, and other applicable authorities. AI-generated cooking instructions, temperatures, times, doneness descriptions, storage suggestions, reheating suggestions, and leftover suggestions are not a substitute for official food safety guidelines or your own judgment.

You are responsible for using proper food safety practices, including but not limited to checking ingredients for freshness and spoilage; reviewing expiration or use-by dates; avoiding cross-contamination; washing hands, surfaces, and produce where appropriate; cooking foods to safe internal temperatures using a food thermometer where appropriate; properly cooling, refrigerating, freezing, storing, reheating, and discarding leftovers; and following any applicable recall, allergy, handling, storage, or preparation warnings.

OnHand may attempt to account for restrictions, preferences, allergies, intolerances, and user-provided information, but we do not guarantee that any recipe will be allergen-free, cross-contamination-free, medically appropriate, nutritionally accurate, safe, properly cooked, properly stored, or suitable for your specific circumstances.

If you or anyone you cook for has allergies, intolerances, medical conditions, dietary restrictions, pregnancy-related restrictions, immune system concerns, religious or ethical food restrictions, or any other health-related food needs, you should not rely on the Service as your only source of guidance. Consult an appropriate medical, nutrition, allergy, or food safety professional where appropriate.

You agree that you are solely responsible for your use of recipes, ingredients, instructions, substitutions, cooking methods, leftovers, storage practices, and food safety decisions, and that New Age Culinary LLC is not responsible for illness, allergic reactions, foodborne illness, contamination, spoilage, improper storage, improper reheating, undercooking, overcooking, cross-contamination, or other food-related harm arising from your use of the Service.

10. Third-Party Sources and Links

The Service may display links, titles, snippets, ingredients, instructions, or other information from third-party websites or services. These third-party sources are provided for convenience, grounding, attribution, or informational purposes only.

We do not own, control, endorse, verify, or guarantee third-party websites, recipes, content, ingredients, claims, safety instructions, nutrition information, ratings, reviews, or availability. Your use of third-party websites or services is at your own risk and may be governed by their own terms and privacy policies.

11. User Content and Community Submissions

The Service may allow you to submit, upload, rate, review, save, share, or provide recipes, photos, feedback, ingredient information, restrictions, preferences, ratings, comments, dislike reasons, and other content or information (“User Content”).

Community recipe submissions may include AI-generated recipes and user-uploaded hero images. At launch, community recipes are reviewed by a human before being added to the public recipe database. Submission does not guarantee approval or publication.

You are responsible for your User Content and represent that you have all rights necessary to submit it. You agree not to submit User Content that is illegal, harmful, unsafe, offensive, abusive, misleading, infringing, spammy, or otherwise violates these Terms.

You retain any rights you may have in User Content that you own. However, by submitting User Content to the Service, you grant New Age Culinary LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, use, reproduce, display, publish, distribute, modify, adapt, format, edit, remove, promote, and otherwise use your User Content in connection with operating, improving, marketing, and promoting the Service.

This license includes the right to display submitted recipes and photos publicly in the OnHand app, on the OnHand website, in promotional materials, and in other marketing or product experiences related to the Service.

If your submitted content includes a photo, you represent that you took the photo, own the photo, or otherwise have permission to submit and license it to us.

12. Review, Moderation, and Removal of Content

We reserve the right, but do not have the obligation, to review, approve, reject, edit, format, remove, hide, or modify any User Content or community recipe at any time, for any reason, including if we believe it violates these Terms, creates legal risk, is low quality, contains unsafe instructions, includes inappropriate content, or is not suitable for the Service.

We may use automated checks, manual review, user feedback, or other moderation methods to detect prohibited or unsafe content. These systems may not catch every issue.

At launch, OnHand does not provide direct user-to-user interaction. Users may report concerns, objectionable content, unsafe recipes, abusive behavior, or other issues by using available feedback features in the app, including dislike feedback where available, or by contacting support@cookonhand.app.

13. Attribution for Community Content

At launch, OnHand may display community recipes without public attribution to a specific user. In the future, if account features are added, OnHand may display a username or other limited attribution with community recipes. We will not intentionally display more personal information than is reasonably needed for the feature, subject to our Privacy Policy and app settings.

14. Prohibited Conduct

You agree not to:

  1. use the Service for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;

  2. submit poisonous, dangerous, unsafe, illegal, or intentionally harmful ingredients, recipes, instructions, or prompts;

  3. submit content that is offensive, harassing, threatening, hateful, explicit, defamatory, invasive of privacy, misleading, or otherwise objectionable;

  4. submit content that infringes or violates another person’s intellectual property, privacy, publicity, or other rights;

  5. upload photos, recipes, text, or other content you do not have the right to use;

  6. attempt to bypass paywalls, subscription checks, free usage limits, security systems, or technical restrictions;

  7. use bots, scripts, macros, scraping tools, automated systems, or similar methods to access or abuse the Service;

  8. reverse engineer, decompile, disassemble, modify, copy, or create derivative works of the app except as permitted by law;

  9. interfere with or disrupt the Service, servers, networks, APIs, AI systems, storage systems, or third-party providers;

  10. attempt to gain unauthorized access to accounts, systems, data, or infrastructure;

  11. use the Service to generate spam, deceptive content, or content intended to harm others; or

  12. use the Service in any way that violates these Terms or applicable law.

15. Accounts and Future Account Features

At launch, OnHand may not require users to create an account. Subscription access is handled through Apple In-App Purchase and Apple’s restore purchase systems.

In the future, we may offer optional account features such as Sign in with Apple, Google sign-in, email sign-in, personalized profiles, usernames, saved preferences, cross-device syncing, or other user-specific features. If account features are added, you may be responsible for keeping your login credentials secure and for activity associated with your account.

We may update these Terms when account features are introduced or changed.

16. Intellectual Property

The Service, including the OnHand app, website, name, logo, branding, design, user interface, software, source code, prompts, workflows, databases, curated content, text, graphics, features, and other materials, is owned by New Age Culinary LLC or its licensors and is protected by intellectual property and other laws.

Except for the limited license expressly granted to you in these Terms, we do not grant you any rights in the Service or our intellectual property.

You may use recipes generated for you by OnHand for personal cooking, saving, and sharing outside the app. You may also use photos of food you personally make. However, you may not copy, reproduce, scrape, redistribute, resell, or exploit substantial portions of the Service, app, database, recipe collection, design, or underlying technology without our permission.

17. Privacy

Your use of the Service is also governed by our Privacy Policy, available at:

The Privacy Policy explains how we collect, use, store, and share information, including information you provide in the app, recipe generation inputs, analytics information, subscription-related information, speech-related information, feedback, recipe snapshots, ratings, photos, and community submissions.

If you are a California resident, additional California privacy disclosures and rights may apply to you as described in our Privacy Policy, including any California Privacy Notice included in that policy.

18. Third-Party Services

The Service may rely on third-party services, software, platforms, APIs, SDKs, and infrastructure providers, including but not limited to Apple services, Apple In-App Purchase, Apple speech recognition services, Supabase, Serper, OpenRouter, Google AI models, Adapty, Mixpanel, and other providers that may be added or changed over time.

By using the Service, you acknowledge that your use may also be subject to applicable third-party terms, policies, and technical limitations. We are not responsible for third-party service outages, errors, limitations, decisions, data practices, or changes.

19. Changes to the Service

We may modify, update, add, remove, suspend, discontinue, limit, or change any part of the Service at any time, including features, recipe generation systems, AI providers, recipe categories, community recipes, free usage limits, subscription options, prices, moderation systems, supported tools, and available content.

We are not liable for any modification, suspension, or discontinuation of the Service, except where prohibited by law.

20. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, used the Service abusively, created legal or security risk, submitted prohibited content, attempted to bypass payment or technical restrictions, or otherwise harmed the Service, other users, or third-party providers.

You may stop using the Service at any time. If you have an active subscription, you must cancel it through your Apple Account subscription settings. Deleting the app does not cancel your subscription.

Sections of these Terms that by their nature should survive termination will survive, including ownership, licenses, disclaimers, limitation of liability, indemnity, dispute terms, and Apple-related terms.

21. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.

We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, safety, and suitability.

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free;

  • recipes will be accurate, safe, complete, or suitable;

  • AI-generated content will be correct or reliable;

  • third-party sources will be accurate or available;

  • the Service will meet your expectations;

  • defects will be corrected; or

  • the Service will be free of harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by law, New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, service interruption, device issues, personal injury, food-related harm, allergic reaction, illness, or other damages arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to OnHand for the Service during the twelve months before the event giving rise to the claim; or (b) fifty U.S. dollars ($50).

Nothing in these Terms limits liability that cannot be limited under applicable law.

23. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use or misuse of the Service;

  • your violation of these Terms;

  • your User Content;

  • your violation of another person’s rights;

  • your violation of applicable law; or

  • your reliance on recipes, ingredients, instructions, substitutions, or other outputs from the Service.

24. Governing Law, Arbitration, and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Please read this Section carefully. You and New Age Culinary LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, the OnHand app, your subscription, or your use of the Service will be resolved by binding individual arbitration, rather than in court, except as stated below.

Arbitration is a process where a neutral arbitrator, not a judge or jury, decides a dispute. By agreeing to these Terms, you and New Age Culinary LLC each waive the right to bring covered disputes in court and the right to have those disputes decided by a judge or jury.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. Before starting arbitration, the party bringing the claim must send the other party written notice describing the dispute and requested relief. Notices to New Age Culinary LLC must be sent to support@cookonhand.app. The parties will try in good faith to resolve the dispute informally for at least 30 days before arbitration begins.

You may opt out of this arbitration agreement by sending written notice to support@cookonhand.app within 30 days after you first accept these Terms. Your notice must clearly state that you want to opt out of arbitration.

You and New Age Culinary LLC agree that disputes must be brought only on an individual basis. You and New Age Culinary LLC waive the right to bring, join, or participate in any class action, class arbitration, collective action, representative action, or similar proceeding, to the maximum extent permitted by law.

This arbitration agreement does not prevent either party from bringing an individual claim in small claims court if the claim qualifies. It also does not prevent either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, security, confidential information, or unauthorized use of the Service.

If any part of this arbitration agreement is found unenforceable, the remaining parts will remain in effect. For any dispute that is not subject to arbitration, you and New Age Culinary LLC agree that the dispute will be brought exclusively in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

We may update these Terms from time to time. If we make changes, we may notify you by posting the updated Terms in the app, on our website, or by other reasonable means. The updated Terms will be effective as of the effective date shown at the top of the Terms, unless otherwise stated.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel any active subscription through your Apple Account settings.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented in the Service, make up the entire agreement between you and New Age Culinary LLC regarding the Service and replace any prior agreements or understandings regarding the Service.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Users may save, rate, submit, and share recipes with the OnHand community, subject to review and approval.

The OnHand website is primarily used to provide information about the app, support information, legal documents, and links to download the app from the App Store.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the permission and supervision of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

The Service is intended for general audiences and is not directed specifically to children under 13.

4. Apple App Store Terms

If you download or use the OnHand app through the Apple App Store, the following additional terms apply:

  1. These Terms are between you and New Age Culinary LLC only, not Apple. New Age Culinary LLC, not Apple, is solely responsible for the Service and its content.

  2. The OnHand app is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the OnHand app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume purchasing rules.

  3. Apple has no obligation to provide maintenance or support services for the OnHand app. New Age Culinary LLC is solely responsible for providing support for the Service as described in these Terms or as required by applicable law.

  4. To the extent any warranty exists and is not effectively disclaimed, New Age Culinary LLC is solely responsible for that warranty. If the OnHand app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the OnHand app.

  5. New Age Culinary LLC, not Apple, is responsible for addressing any claims relating to the OnHand app or your possession or use of the app, including product liability claims, legal or regulatory compliance claims, and claims arising under consumer protection, privacy, or similar laws.

  6. If a third party claims that the OnHand app or your possession and use of the app infringes that third party’s intellectual property rights, New Age Culinary LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.

  7. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

  8. You must comply with all applicable third-party terms when using the Service, including Apple’s terms, your wireless data service agreement, and the terms of any third-party services used in connection with the Service.

  9. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

You are responsible for using proper food safety practices, including but not limited to checking ingredients for freshness and spoilage; reviewing expiration or use-by dates; avoiding cross-contamination; washing hands, surfaces, and produce where appropriate; cooking foods to safe internal temperatures using a food thermometer where appropriate; properly cooling, refrigerating, freezing, storing, reheating, and discarding leftovers; and following any applicable recall, allergy, handling, storage, or preparation warnings.

OnHand may attempt to account for restrictions, preferences, allergies, intolerances, and user-provided information, but we do not guarantee that any recipe will be allergen-free, cross-contamination-free, medically appropriate, nutritionally accurate, safe, properly cooked, properly stored, or suitable for your specific circumstances.

If you or anyone you cook for has allergies, intolerances, medical conditions, dietary restrictions, pregnancy-related restrictions, immune system concerns, religious or ethical food restrictions, or any other health-related food needs, you should not rely on the Service as your only source of guidance. Consult an appropriate medical, nutrition, allergy, or food safety professional where appropriate.

You agree that you are solely responsible for your use of recipes, ingredients, instructions, substitutions, cooking methods, leftovers, storage practices, and food safety decisions, and that New Age Culinary LLC is not responsible for illness, allergic reactions, foodborne illness, contamination, spoilage, improper storage, improper reheating, undercooking, overcooking, cross-contamination, or other food-related harm arising from your use of the Service.

10. Third-Party Sources and Links

The Service may display links, titles, snippets, ingredients, instructions, or other information from third-party websites or services. These third-party sources are provided for convenience, grounding, attribution, or informational purposes only.

We do not own, control, endorse, verify, or guarantee third-party websites, recipes, content, ingredients, claims, safety instructions, nutrition information, ratings, reviews, or availability. Your use of third-party websites or services is at your own risk and may be governed by their own terms and privacy policies.

11. User Content and Community Submissions

The Service may allow you to submit, upload, rate, review, save, share, or provide recipes, photos, feedback, ingredient information, restrictions, preferences, ratings, comments, dislike reasons, and other content or information (“User Content”).

Community recipe submissions may include AI-generated recipes and user-uploaded hero images. At launch, community recipes are reviewed by a human before being added to the public recipe database. Submission does not guarantee approval or publication.

You are responsible for your User Content and represent that you have all rights necessary to submit it. You agree not to submit User Content that is illegal, harmful, unsafe, offensive, abusive, misleading, infringing, spammy, or otherwise violates these Terms.

You retain any rights you may have in User Content that you own. However, by submitting User Content to the Service, you grant New Age Culinary LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, use, reproduce, display, publish, distribute, modify, adapt, format, edit, remove, promote, and otherwise use your User Content in connection with operating, improving, marketing, and promoting the Service.

This license includes the right to display submitted recipes and photos publicly in the OnHand app, on the OnHand website, in promotional materials, and in other marketing or product experiences related to the Service.

If your submitted content includes a photo, you represent that you took the photo, own the photo, or otherwise have permission to submit and license it to us.

12. Review, Moderation, and Removal of Content

We reserve the right, but do not have the obligation, to review, approve, reject, edit, format, remove, hide, or modify any User Content or community recipe at any time, for any reason, including if we believe it violates these Terms, creates legal risk, is low quality, contains unsafe instructions, includes inappropriate content, or is not suitable for the Service.

We may use automated checks, manual review, user feedback, or other moderation methods to detect prohibited or unsafe content. These systems may not catch every issue.

At launch, OnHand does not provide direct user-to-user interaction. Users may report concerns, objectionable content, unsafe recipes, abusive behavior, or other issues by using available feedback features in the app, including dislike feedback where available, or by contacting support@cookonhand.app.

13. Attribution for Community Content

At launch, OnHand may display community recipes without public attribution to a specific user. In the future, if account features are added, OnHand may display a username or other limited attribution with community recipes. We will not intentionally display more personal information than is reasonably needed for the feature, subject to our Privacy Policy and app settings.

14. Prohibited Conduct

You agree not to:

  1. use the Service for any illegal, harmful, fraudulent, abusive, or unauthorized purpose;

  2. submit poisonous, dangerous, unsafe, illegal, or intentionally harmful ingredients, recipes, instructions, or prompts;

  3. submit content that is offensive, harassing, threatening, hateful, explicit, defamatory, invasive of privacy, misleading, or otherwise objectionable;

  4. submit content that infringes or violates another person’s intellectual property, privacy, publicity, or other rights;

  5. upload photos, recipes, text, or other content you do not have the right to use;

  6. attempt to bypass paywalls, subscription checks, free usage limits, security systems, or technical restrictions;

  7. use bots, scripts, macros, scraping tools, automated systems, or similar methods to access or abuse the Service;

  8. reverse engineer, decompile, disassemble, modify, copy, or create derivative works of the app except as permitted by law;

  9. interfere with or disrupt the Service, servers, networks, APIs, AI systems, storage systems, or third-party providers;

  10. attempt to gain unauthorized access to accounts, systems, data, or infrastructure;

  11. use the Service to generate spam, deceptive content, or content intended to harm others; or

  12. use the Service in any way that violates these Terms or applicable law.

15. Accounts and Future Account Features

At launch, OnHand may not require users to create an account. Subscription access is handled through Apple In-App Purchase and Apple’s restore purchase systems.

In the future, we may offer optional account features such as Sign in with Apple, Google sign-in, email sign-in, personalized profiles, usernames, saved preferences, cross-device syncing, or other user-specific features. If account features are added, you may be responsible for keeping your login credentials secure and for activity associated with your account.

We may update these Terms when account features are introduced or changed.

16. Intellectual Property

The Service, including the OnHand app, website, name, logo, branding, design, user interface, software, source code, prompts, workflows, databases, curated content, text, graphics, features, and other materials, is owned by New Age Culinary LLC or its licensors and is protected by intellectual property and other laws.

Except for the limited license expressly granted to you in these Terms, we do not grant you any rights in the Service or our intellectual property.

You may use recipes generated for you by OnHand for personal cooking, saving, and sharing outside the app. You may also use photos of food you personally make. However, you may not copy, reproduce, scrape, redistribute, resell, or exploit substantial portions of the Service, app, database, recipe collection, design, or underlying technology without our permission.

17. Privacy

Your use of the Service is also governed by our Privacy Policy, available at:

The Privacy Policy explains how we collect, use, store, and share information, including information you provide in the app, recipe generation inputs, analytics information, subscription-related information, speech-related information, feedback, recipe snapshots, ratings, photos, and community submissions.

If you are a California resident, additional California privacy disclosures and rights may apply to you as described in our Privacy Policy, including any California Privacy Notice included in that policy.

18. Third-Party Services

The Service may rely on third-party services, software, platforms, APIs, SDKs, and infrastructure providers, including but not limited to Apple services, Apple In-App Purchase, Apple speech recognition services, Supabase, Serper, OpenRouter, Google AI models, Adapty, Mixpanel, and other providers that may be added or changed over time.

By using the Service, you acknowledge that your use may also be subject to applicable third-party terms, policies, and technical limitations. We are not responsible for third-party service outages, errors, limitations, decisions, data practices, or changes.

19. Changes to the Service

We may modify, update, add, remove, suspend, discontinue, limit, or change any part of the Service at any time, including features, recipe generation systems, AI providers, recipe categories, community recipes, free usage limits, subscription options, prices, moderation systems, supported tools, and available content.

We are not liable for any modification, suspension, or discontinuation of the Service, except where prohibited by law.

20. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, used the Service abusively, created legal or security risk, submitted prohibited content, attempted to bypass payment or technical restrictions, or otherwise harmed the Service, other users, or third-party providers.

You may stop using the Service at any time. If you have an active subscription, you must cancel it through your Apple Account subscription settings. Deleting the app does not cancel your subscription.

Sections of these Terms that by their nature should survive termination will survive, including ownership, licenses, disclaimers, limitation of liability, indemnity, dispute terms, and Apple-related terms.

21. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.

We disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, safety, and suitability.

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free;

  • recipes will be accurate, safe, complete, or suitable;

  • AI-generated content will be correct or reliable;

  • third-party sources will be accurate or available;

  • the Service will meet your expectations;

  • defects will be corrected; or

  • the Service will be free of harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by law, New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, service interruption, device issues, personal injury, food-related harm, allergic reaction, illness, or other damages arising from or related to your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to OnHand for the Service during the twelve months before the event giving rise to the claim; or (b) fifty U.S. dollars ($50).

Nothing in these Terms limits liability that cannot be limited under applicable law.

23. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless New Age Culinary LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use or misuse of the Service;

  • your violation of these Terms;

  • your User Content;

  • your violation of another person’s rights;

  • your violation of applicable law; or

  • your reliance on recipes, ingredients, instructions, substitutions, or other outputs from the Service.

24. Governing Law, Arbitration, and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Please read this Section carefully. You and New Age Culinary LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, the OnHand app, your subscription, or your use of the Service will be resolved by binding individual arbitration, rather than in court, except as stated below.

Arbitration is a process where a neutral arbitrator, not a judge or jury, decides a dispute. By agreeing to these Terms, you and New Age Culinary LLC each waive the right to bring covered disputes in court and the right to have those disputes decided by a judge or jury.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. Before starting arbitration, the party bringing the claim must send the other party written notice describing the dispute and requested relief. Notices to New Age Culinary LLC must be sent to support@cookonhand.app. The parties will try in good faith to resolve the dispute informally for at least 30 days before arbitration begins.

You may opt out of this arbitration agreement by sending written notice to support@cookonhand.app within 30 days after you first accept these Terms. Your notice must clearly state that you want to opt out of arbitration.

You and New Age Culinary LLC agree that disputes must be brought only on an individual basis. You and New Age Culinary LLC waive the right to bring, join, or participate in any class action, class arbitration, collective action, representative action, or similar proceeding, to the maximum extent permitted by law.

This arbitration agreement does not prevent either party from bringing an individual claim in small claims court if the claim qualifies. It also does not prevent either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, security, confidential information, or unauthorized use of the Service.

If any part of this arbitration agreement is found unenforceable, the remaining parts will remain in effect. For any dispute that is not subject to arbitration, you and New Age Culinary LLC agree that the dispute will be brought exclusively in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

25. Changes to These Terms

We may update these Terms from time to time. If we make changes, we may notify you by posting the updated Terms in the app, on our website, or by other reasonable means. The updated Terms will be effective as of the effective date shown at the top of the Terms, unless otherwise stated.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel any active subscription through your Apple Account settings.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented in the Service, make up the entire agreement between you and New Age Culinary LLC regarding the Service and replace any prior agreements or understandings regarding the Service.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
